Shabia Johnakin got probation for gun possession.

Never mind that the 20-year-old Brooklyn high school dropout was in just the kind of shootout that claims the lives of so many innocent bystanders.

Never mind the gunplay was outside early on a summer evening when kids are playing.

Never mind he stopped firing only because his 9-mm. pistol jammed.

Never mind the gunplay ended with his buddy firing two rounds at police.

Johnakin got this deal even though he was without fame, wealth or a fancy lawyer.

What Johnakin had was a judge who decided to give him a break.

Brooklyn Supreme Court Justice Abraham Gerges did so even though the Brooklyn district attorney's office wanted Johnakin to get no better a deal than Burress got that same month across the bridge in Manhattan.

The way Johnakin repaid Gerges was to go out and get arrested for having another 9-mm. pistol near the spot ofthe first arrest.

That puts both arrests within three blocks of a grammar school and five day care centers.

Prosecutors want the judge to junk the plea deal and give Johnakin 10 years on the first gun charge and another 10 on the second, consecutively.

"This guy's a menace," Brooklyn District Attorney Charles Hynes said.

Hynes refrained from blasting the judge, who explained his reasoning at an Aug. 6 hearing. Gerges noted that Johnakin had a reasonably clean record and was eligible for youthful offender status. He had been held in lieu of $25,000 bail for a year prior to agreeing to plead guilty.

"If I went along with the district attorney and gave him a two-year sentence, he will be out in a couple of months. He would have no job. No schooling or nothing. He probably would be in front of another judge a year later with other problems," Gerges said.

"If I put him into a program he will go to school, learn a job, get a job. He will be productive."

In objecting, Assistant District Attorney Louis Lieberman emphasized the seriousness of the offense. He also said that after fleeing, Johnakin and buddy Anthony Hall were arrested in anapartment they had taken over from the mentally disabled tenant.

"That is part of who the defendant is," the prosecutor said.

Gerges was unmoved, and the law does not allow the prosecution to appeal a judge's decision in such circumstances. Gerges did require Johnakin to confess to what he had done.

"I was walking to the store," Johnakin said. "I heard someone call our name. We turned around and shots was fired."

"Did you fire shots at the boys?" the prosecutor asked.

"Yes," Johnakin said.

"What happened to your gun?" the prosecutor asked.

"It jammed up," Johnakin said.

Johnakin returned to the street with a warning from Gerges that he faced three years if he failed to attend an educational program or otherwise messed up.

That was shortly before Burress got the two years. Lil Wayne got hit with a year and Mayor Bloomberg warned that anybody caught with a gun would do time.

Yet, there was Johnakin, walking around.

On the evening of Sept. 27, Johnakin was arrested again for gun possession. A 15-year-old subsequently volunteered to say the gun was his, but then backed down.

Fantastically, Johnakin had remained at liberty. That may change after a hearing today.

The judge cannot be happy. The Detectives' Endowment Association has written the judge a letter asking that Johnakin be hit with the maximum. The prosecution wants Johnakin to get more than double the eight years his buddy got for firing at the cops.

Meanwhile, word came from the Bronx of a 14-year-old girl hit by a stray round in just the kind of shootout that Johnakin was in before he got a deal not even a star could manage.

Created by a certain Dr. John of Washington, News1News captures and uploads Fox News segments. And since this is done without the permission of Fox News, it is but logical that Fox News can claim its rights on the footages.
